In Kyrgyzstan, they want to legalize digital evidence and seize crypto assets

In Kyrgyzstan, a draft law has been developed that proposes amendments to the Criminal Code, the Criminal Procedure Code, and the Code of Offenses. This bill aims to legalize the use of digital evidence, including correspondence, files, and user information.

It is proposed to establish clear rules for the recording, seizure, storage, and protection of digital data to minimize the likelihood of their being deemed inadmissible in court proceedings.

The authors of the bill point to the increasing number of crimes related to digital technologies and emphasize that the current regulations do not meet modern realities. They propose to unify the terminology in accordance with the Digital Code, update the classifications of cybercrimes and investigation procedures, as well as create separate rules for working with virtual assets.

Furthermore, the draft law includes provisions for the possibility of seizing and confiscating crypto assets, their storage until a court decision, as well as mechanisms for the confiscation of similar property or monetary amounts if the assets have been concealed, destroyed, or alienated.

The document also provides for measures to improve international cooperation in the field of digital data, including the temporary preservation of information upon requests and the exchange of materials in electronic format in established cases.

The accompanying note states that the implementation of this project will not require additional costs from the state budget.
