Kyrgyzstan has filed a lawsuit against Russia in the court of the Eurasian Economic Union. This information was announced during a meeting of the committee of the Jogorku Kenesh, which deals with labor, health, and social policy issues. The main reason for the appeal was the problems with the implementation of EAEU agreements related to medical services and insurance policies for migrants from Kyrgyzstan in the Russian Federation. What is the EAEU Court?

The Eurasian Economic Union Court was established in accordance with the EAEU Treaty, signed on May 29, 2014.

Its location is in Minsk (Belarus).

The chairman of the court is Alexey Dronov, who previously held the position of Consul General of Russia in Bonn, and the deputy chairperson is Aizhamal Azhibraimova, a former judge of the Supreme Court of Kyrgyzstan.

What is the function of the EAEU Court?

The main task of the court is to ensure the uniform application of the norms of the EAEU Treaty, as well as international agreements concluded within the framework of the union.

The court consists of two judges from each EAEU member state.

What is the essence of Kyrgyzstan's lawsuit?

The head of the Mandatory Health Insurance Fund of the Kyrgyz Republic, Azamat Mukhanov, noted at a parliamentary meeting that the Russian side is not fulfilling the conditions established by the EAEU agreements, which require the issuance of mandatory health insurance policies for the family members of working citizens from Kyrgyzstan.

Furthermore, the fund clarified that the lawsuit was filed on behalf of the Cabinet of Ministers and was prepared by the Center for Judicial Representation under the Ministry of Justice of the Kyrgyz Republic.

The appeal concerns the clarification of Articles 3 and 4 of Article 98 of the EAEU Treaty in the context of access to social security, including health insurance, for the family members of workers from EAEU member states.

The fund also reported that this issue is systematically raised by the Kyrgyz side at various levels within the union, and the appeal to the court is part of the dialogue process in the context of integration.

What are the main provisions of the treaty?

Since January 1, 2017, workers from EAEU countries have had access to health insurance in Russia.

Article 98. Rights and Obligations of Workers from Member States

Appendix states that emergency medical care is provided to workers and their family members free of charge, regardless of the presence of a medical insurance policy. However, if treatment continues after the immediate threat is eliminated, the patient must pay the actual costs at established rates.

How is Kyrgyzstan fulfilling its obligations?

The Mandatory Health Insurance Fund noted that Kyrgyzstan strictly fulfills its obligations within the EAEU.

In the country, family members of workers from EAEU member states who are legally present here have access to medical care under the state program of mandatory health insurance.

New migration laws in Russia

New rules concerning migration policy have come into effect in Russia.

The conditions for foreign citizens to obtain a medical insurance policy have changed. According to the information and legal portal "Garant," to receive free medical assistance, migrants must legally work in Russia for at least five years.

When will the court's decision be known?

Azamat Mukhanov, the head of the Mandatory Health Insurance Fund, reported on January 27, 2026, that the court session has already taken place, and the decision will be announced in two weeks.
