Kyrgyzstan has filed a lawsuit against Russia in the EAEU. Comment from the FOMS

The Mandatory Health Insurance Fund (MHIF) emphasized that the Kyrgyz Republic is fulfilling its obligations within the framework of the Eurasian Economic Union. Citizens of the member states of the Union who are on the territory of Kyrgyzstan have the right to medical care within the mandatory health insurance system according to the State Guarantees Program.

At a meeting of the Jogorku Kenesh Committee on Labor, Health, Women's Affairs, and Social Issues on January 27, Azamat Mukhanov, head of the MHIF, stated: "Kyrgyzstan has filed a lawsuit against the Russian Federation, which is not fulfilling the conditions set out in the EAEU agreements. The mandatory health insurance policy should also extend to the family members of workers employed in Russia. This agreement has been signed by five states."

The MHIF added that the initiative to appeal to the EAEU court was given on the instruction of the Cabinet of Ministers of Kyrgyzstan and was submitted through the Judicial Representation Center of the Ministry of Justice of the country.

The legal appeal concerns the clarification of paragraphs 3 and 4 of Article 98 of the Treaty on the Eurasian Economic Union dated May 29, 2014, regarding access to social security, including mandatory health insurance for the family members of workers from the EAEU member states.

The issue of access for the family members of Kyrgyz citizens working abroad to the mandatory health insurance system in other EAEU member countries is being raised by the Kyrgyz side on various platforms, including the working bodies of the Union and intergovernmental commissions. The court appeal is part of the dialogue within the framework of integration processes.
