According to the document, the conclusion will be sent to the Jogorku Kenesh for the necessary domestic procedures.
The conclusion indicates that the so-called "IV Big" protocol was developed as a result of the work of a consolidated working group aimed at improving the provisions of the EEU Treaty from 2022 to 2024 and includes 33 amendments.
The amendments are aimed at addressing shortcomings, clarifying definitions in the Treaty, as well as granting the Eurasian Economic Commission the authority to approve the methodology for qualifying obstacles in the EEU internal market, with subsequent recognition of barriers and restrictions as eliminated.
Among the key changes listed in the conclusion:
- changes to the annexes of the Treaty (in particular, No. 5, 9, 10, 16, 19, 21), including updates on the exchange of information regarding import duties and clarification of certain terms;
- replacement of the indicative LIBOR rate with SOFR for investment provisions in US dollars;
- clarifications regarding the enforcement of decisions by the EEC and the listing of fines;
- introduction of the possibility of using electronic permits for international road transport within the framework of transport control at the external border of the EEU;
- changes in the field of public procurement, including mutual recognition of bank guarantees, expansion of the list of cases for single-source procurement, and requirements for publishing information on the web portal;
- technical amendments, including the updating of the name of the capital of Kazakhstan in several annexes (replacing "Nur-Sultan" with "Astana").
The document also emphasizes that the protocol, signed by the heads of the EEU member states at the meeting of the Supreme Eurasian Economic Council, requires mandatory ratification and the completion of domestic procedures. Previously, this protocol was approved by the Cabinet's order dated January 9, 2025, under number 1-r.
Furthermore, the conclusion states that the text of the protocol was reviewed and received approval from the relevant committees of the Jogorku Kenesh (conclusions dated November 26, November 28, and December 5, 2024).
It is also noted that the protocol does not contradict the Constitution and legislation of the Kyrgyz Republic. The conclusion states that its ratification will not lead to social, economic, legal, environmental, or financial consequences.
