The GKNB proposes to amend the constitutional law concerning the prosecution authorities. This draft law has already been published for public discussion.

The organization emphasized that military service is a special type of public service, which, according to legislation, takes precedence over other forms of public service.

However, the current rules practically equate military ranks with class ranks and special ranks, although they should differ significantly while maintaining the primacy of military rank.

The GKNB believes that assigning military ranks to prosecutors working in civilian institutions is impractical and unacceptable, as it blurs the lines between military and civilian service and undermines the status of military service.

According to the new draft, it will be the Attorney General who will determine the procedure for assigning special class ranks, class ranks, or military ranks to prosecutors.

As part of the proposed changes, prosecutors will be assigned the following ranks and titles:



For special class ranks, the following terms are established:



No terms are established for Advisor of Justice 1st Class.

The highest special class rank "State Advisor of Justice 3rd Class" may be assigned to the Attorney General no earlier than six months and to other officials holding corresponding positions - no earlier than two years from the date of appointment.

Periods of work in political and higher administrative positions will be counted for the appointment to the highest special class rank "State Advisor of Justice 3rd Class" for those who previously held such positions and were subsequently appointed to positions requiring replacement by individuals with the highest special class rank.

The assignment of special class ranks, such as State Advisor of Justice 3rd, 2nd, and 1st Classes, as well as the military rank of Major General of Justice, is carried out by the President.

The assignment of other special class ranks, such as Advisor of Justice 3rd, 2nd, and 1st Classes, Lawyers 3rd, 2nd, and 1st Classes, as well as Junior Lawyer and military ranks - Junior Lieutenant, Lieutenant, Senior Lieutenant, Captain, Major, Lieutenant Colonel, and Colonel of Justice - will be at the discretion of the Attorney General.

The assignment of a special class rank (or military rank) outside the established sequence is not permitted.

Additionally, the heads of prosecution authorities have the right to demote employees in special class rank or military rank by one step for not performing their duties properly or violating professional ethics.
