Government agencies continue to demand certificates despite the Digital Code — Dastan Bekeshev

The deputy expressed dissatisfaction with the disregard for norms regarding the abandonment of paper documents by the Ministry of Internal Affairs and the Ministry of Justice


At a meeting of the committee of the Jogorku Kenesh, Deputy Dastan Bekeshev criticized the activities of state and municipal institutions that continue to request various certificates and copies of documents from citizens, despite the entry into force of the Digital Code.

He emphasized that according to the Digital Code, if a document is available in electronic format, there is no need to provide it in paper form. Nevertheless, government agencies continue to ignore this requirement.

As an illustration, Bekeshev cited the case of the Ministry of Internal Affairs, which requires taxi drivers to provide a certificate of no criminal record and a copy of their passport, while the Ministry itself issues certificates of no criminal record.

“Why should citizens provide a certificate that a government agency can obtain on its own? Why was the Digital Code adopted then?” the deputy questioned.

The deputy also noted that many agencies justify their actions by claiming a lack of access to the "Tunduk" system, which leads to the bureaucratic burden being shifted onto citizens.

Additionally, Bekeshev cited the Ministry of Justice, which requires residents to provide an extract from the State Cadastre for the registration of homeowners' associations (HOAs). As a result, residents are forced to spend significant amounts to obtain certificates for the registration of a single HOA.

The deputy emphasized that such practices seem particularly absurd in light of the fact that Justice Minister Ayaz Bayetov heads the commission for combating bureaucracy.

In light of the above, Bekeshev proposed not only to enshrine the prohibition on requesting unnecessary certificates in legislation but also to introduce accountability for state and municipal bodies for non-compliance with these norms.
