Dastan Bekeshev, a deputy of the Jogorku Kenesh from district No. 22, has proposed amendments to the Code of Offenses concerning obstacles in election campaigning. The draft amendments are available on the parliament's website.

Essence of the Proposals

New points are planned to be added to Article 65, dedicated to "Violations of the conditions for conducting election campaigning":

4. Individuals who obstruct lawful campaigning will be fined 10,000 soms.

5. If the obstacles are created by individuals responsible for managing homeowners' associations or territorial public self-governance, the fine will amount to 20,000 soms.

Reasons for the Changes

As the deputy points out in the justification, according to the Law "On Elections," employees of territorial self-governance are not allowed to engage in campaigning. Involving housing committee members, chairpersons of homeowners' associations, and neighborhood representatives in campaigning is considered an abuse of administrative resources. Nevertheless, some housing committee members and chairpersons continue to secretly support candidates and conduct campaigning, often without public disclosure.

“Given the administrative resources of such individuals, they are capable of influencing commercial entities (stores and pavilions) located in the area and prohibiting the placement of political advertisements for certain candidates. Moreover, they can create unequal conditions for campaigning, allowing some candidates to hold meetings while making it difficult for others to organize such gatherings,” emphasizes the initiator.

Additionally, ordinary citizens can obstruct lawful campaigning by disrupting meetings, creating provocations, or pressuring campaigners.

It is necessary to establish accountability for obstructing lawful campaigning.

A representative of the candidate Ilim Karybekov appealed to the Central Election Commission with a complaint about similar situations during the recent elections to the Jogorku Kenesh. “The campaigners of the applicant were denied access to the territory of one of the apartment buildings, citing that this building allegedly 'works' for the candidate Umbetaly Kydyraliev. These circumstances, according to the applicant, indicate the creation of obstacles for campaigning activities and a violation of the principles of equality among candidates,” states the complaint.
