The Ministry of Natural Resources proposes to introduce liability for the circulation of environmentally harmful bulk coal.

The Ministry of Natural Resources, Ecology, and Technical Supervision has put forward for public discussion a draft law "On Amendments to the Code of the Kyrgyz Republic on Offenses."

The aim of the new bill is to implement powers and impose effective control in the field of environmental protection, as well as oversight of industrial safety and subsurface resource protection. This will enable a prompt response to violations of environmental legislation.

According to data from the World Bank on air quality in Bishkek for 2023, a significant contribution to the annual average concentrations of PM2.5 particles in the capital comes from residential heating (29%) and transportation (27%). The use of low-quality fuel, including small-sized bulk coal, worsens the air pollution situation.

The Cabinet of Ministers issued Resolution No. 639 on October 6, 2025, which prohibits the import, storage, sale, and use of bulk coal with a fraction of up to 13 mm. This type of fuel is considered one of the main sources of air pollution, as its combustion releases fine particles and toxic gases.

The current version of the Code on Offenses lacks an article that provides for liability for violating this ban. The introduction of a new article is required to ensure the enforcement of Resolution No. 639 and to enhance control over air quality.

Control over the enforcement of the ban, as well as the consideration of cases of offenses and the application of administrative measures, will be carried out by the Service for Environmental and Technical Supervision under the Ministry of Natural Resources, Ecology, and Technical Supervision.
