According to the proposals, it is planned to tighten penalties for those who marry individuals who have not reached the marriageable age, especially if this offense has been committed repeatedly after an administrative penalty has been imposed. In such cases, a fine is provided in the range of 50 to 100 basic calculation amounts (BCA), which is equivalent to an amount from 20.6 to 41.2 million sums, as well as mandatory community service for a period of 240 to 300 hours or corrective labor for up to two years.
For comparison, according to current legislation, a similar offense carries a fine of 20 to 30 BCA, mandatory work of up to 240 hours, or corrective labor for up to one year.
In addition, the draft law introduces a ban on marital relations between relatives in the collateral line of kinship of the second, third, and fourth degrees, including:
- marriage between an uncle and a niece;
- marriage between an aunt and a nephew;
- marriages between first, second, and third cousins.
Currently, the Family Code of Uzbekistan prohibits marriages between relatives in the direct ascending and descending line, as well as between full and half-siblings, and between adoptive parents and adopted children.
Additionally, the draft law proposes to establish a norm allowing the district or city hokim to reduce the marriageable age by up to one year in cases related to pregnancy or childbirth upon the request of individuals wishing to marry.
A fine of 70 BCA is also provided for marrying or entering into marriage in the presence of legal obstacles.
