Deputy Minister of Internal Affairs: Only the court can order the confiscation of property

- During the meeting of the Committee of the Jogorku Kenesh on judicial and legal issues on January 20, 2026, deputy Altynbek Kilychbaev inquired about who exactly makes decisions regarding the confiscation of property: investigative bodies or the court.

In response to this question, Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev emphasized that such decisions can only be made by the court.

This issue was raised during the discussion of the draft Law of the Kyrgyz Republic "On Amendments to Certain Legislative Acts of the Kyrgyz Republic (to the Criminal Executive Code, Criminal Code, and Criminal Procedure Code)" in its first reading.

According to the deputy minister, the draft law aims to strengthen measures against organized crime and its complete eradication.

"It is planned to introduce the concept of recidivism of crimes and address a number of issues related to the confiscation of property," noted Erkebek Ashirkhodzhaev.

The draft law includes amendments to three main codes: the Criminal Code, Criminal Procedure Code, and Criminal Executive Code. The main innovations provide for tougher penalties for organized crime, the introduction and clarification of norms regarding recidivism, as well as the optimization of the processes for confiscating property obtained through criminal means.

The committee approved the draft law in its first reading.
