The Ministry of Internal Affairs proposes to reinstate the recidivism institute. The Housing Committee reviewed the bill in its first reading.

The Committee of the Jogorku Kenesh, which deals with issues of the judicial system, law enforcement, and the fight against crime, approved a draft law amending key codes: the Criminal Executive, Criminal, and Criminal Procedure Codes. This decision was made during the first reading.

Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev noted that after the abolition of the recidivism institution in 2019, there has been a rise in the influence of organized crime groups, which is linked to insufficient accountability for repeat offenses.

Currently, repeat offenders face the same penalties as first-time offenders, including probation and parole. However, the new draft law proposes to tighten the responsibility for repeat offenders. According to the proposed changes, the minimum punishment for recidivism will be half of the maximum penalty, while for dangerous recidivism it will increase to two-thirds, and for particularly dangerous recidivism to three-quarters of the maximum.

It is also important to note that individuals who commit crimes as part of an organized group or criminal community during dangerous or particularly dangerous recidivism will not be able to expect release from criminal liability even if an agreement is reached with the victim. Recidivism will be considered an aggravating circumstance, which excludes the application of probation supervision and parole for such criminals.

Furthermore, the draft law introduces additional qualifying features for a number of crimes related to organized crime, such as murder, robbery, extortion, and others. If crimes are committed during dangerous or particularly dangerous recidivism, this will be classified as a more serious crime and will lead to more severe consequences.

The committee members unanimously supported the proposed changes to the draft law.
