The plaintiff claims that the decree and the project submitted for voting violate the constitutional law "On the Republican Referendum," which prohibits putting to a nationwide vote issues that could restrict the constitutional rights and freedoms of citizens. He also refers to the constitutional norm that guarantees citizens the right to participate in the governance of the state both directly and through their representatives.

According to Alnur Ilyashev, this project introduces changes to the fundamental constitutional principles, and he insists that the decree contradicts the Constitution.

The activist intends to achieve recognition of this document as illegal.

The referendum concerning the new Constitution is scheduled for March 15 in Kazakhstan.

Alnur Ilyashev is an activist from Almaty who was convicted in 2020 for spreading false information. The reason was his posts on social media, in which he criticized the Nur Otan party (now known as Amanat) and the authorities' anti-crisis policies during the pandemic.

The court sentenced him to three years of restricted freedom and prohibited him from engaging in public and political activities.
