The Cabinet of Ministers has changed the procedure for administering the collection of license retention fees for subsoil users.

The Cabinet of Ministers of Kyrgyzstan signed a resolution on March 9, 2026, regarding changes to the rules for collecting non-tax revenues from subsoil users. These changes are aimed at fulfilling subparagraph 5 of paragraph 3 of Article 16 of the Code of the Kyrgyz Republic on non-tax revenues.

The amendments concern the Ministry of Natural Resources, Ecology and Technical Supervision, as well as the Kyrgyz Geological Service. According to the new regulations, these bodies will no longer be responsible for fees related to the retention of licenses for subsoil use. At the same time, they have been granted the authority to approve calculations of fees for license retention submitted by subsoil users.

In addition, the Ministry of Natural Resources and the Kyrgyz Geological Service will exercise control over the accuracy of calculations and reports, as well as the recalculation of this fee.

This resolution was published in the newspaper "Erkin Too" on March 17, 2026, and comes into effect 15 days after its official publication.

Chapter 1. General Provisions

1. The Ministry of Natural Resources, Ecology and Technical Supervision of the Kyrgyz Republic (hereinafter referred to as the Ministry) is the authorized executive body responsible for developing and implementing state policy in the field of environmental protection, ecology and climate, geology and subsoil use, as well as monitoring compliance with environmental and industrial safety standards.

2. In its work, the Ministry is guided by the Constitution of the Kyrgyz Republic, its laws, presidential decrees, resolutions of the Cabinet of Ministers, and other regulatory legal acts.

3. The Ministry is a legal entity and has a seal with the coat of arms of the Kyrgyz Republic, as well as the right to open accounts in the Treasury of the Ministry of Finance.

The Ministry replaced the State Committee for Ecology and Climate of the Kyrgyz Republic.

4. The structure of the Ministry includes subordinate institutions, state enterprises, and funds that have the status of a legal entity.

5. The full name of the Ministry:

- in the state language: "Кыргыз Республикасынын Жаратылыш ресурстары, экология жана техникалык козомол министрлиги";

- in the official language: "Ministry of Natural Resources, Ecology and Technical Supervision of the Kyrgyz Republic".

Abbreviated official name:

- in the state language: "ЖРЭТКМ";

- in the official language: "МПРЭТН".

7. The Ministry performs its functions in cooperation with state bodies, local authorities, and scientific organizations.

8. The Ministry has the right to enter into civil legal relations in its own name in accordance with the legislation of the Kyrgyz Republic.

Chapter 2. Purpose of the Ministry

9. The main purpose of the Ministry is to preserve the unique ecosystem of the Kyrgyz Republic and ensure comfortable living conditions for citizens, protect the environment and natural resources.

Chapter 3. Tasks of the Ministry

10. The tasks of the Ministry include:

- developing and implementing state policy in the field of environmental protection and natural resources;

- introducing modern technologies in the field of cartography and geodesy;

- increasing the effectiveness of state regulation in the field of ecology and natural resource use;

- preserving and rationally using biological diversity;

- systematic study and reproduction of natural resources;

- monitoring compliance with safety and environmental protection standards;

- developing a "green" economy and adapting to climate change;

- establishing international cooperation in the field of ecology and safety;

- creating and maintaining geographic information systems;

- determining the boundaries of specially protected natural areas.

Chapter 4. Functions of the Ministry

11. The functions of the Ministry include:

1) implementation of sectoral policy:

- developing and implementing state policy in the field of environmental protection;

- creating strategies and programs corresponding to the Ministry's competence;

- participating in the development of regulatory legal acts;

- organizing the inventory of pollutant emissions;

- participating in the development of statistical forms for environmental protection;

- approving proposals for the creation of specially protected areas;

- conducting comprehensive geological studies of the territory;

- monitoring mineral resource reserves;

- attracting investments in the Ministry's area of activity;

2) regulatory functions:

- state regulation in the field of environmental protection;

- issuing licenses for licensed activities;

- monitoring compliance with environmental legislation;

- organizing the maintenance of environmental passports for enterprises;

- analyzing the state of environmental pollution;

3) coordination and monitoring functions:

- coordinating the activities of state bodies on environmental protection issues;

- monitoring the use of natural resources;

4) state control and supervision functions:

- monitoring compliance with environmental safety and protection;

5) service provision functions:

- organizing laboratory research;

6) support functions:

- disseminating environmental information and organizing scientific research.

Chapter 5. Rights of the Ministry

12. The Ministry has the right to:

- submit proposals to the Cabinet of Ministers;

- create working groups and commissions;

- represent the interests of Kyrgyzstan in international organizations;

- attract funding for the implementation of its functions;

- receive information from enterprises and organizations;

- conduct inspections and impose sanctions for violations.

Chapter 6. Organization of the Ministry's Activities

13. The Ministry is headed by a minister appointed by the President of the Kyrgyz Republic.

14. The Ministry includes positions for the first deputy and deputy ministers.

15. The minister is responsible for fulfilling the Ministry's tasks and represents it in relations with other bodies.

16. The deputy ministers organize work in their respective areas.

17. Decisions of the Ministry are made in the form of orders signed by the minister or his deputy.

18. A board is established in the Ministry, which includes the minister and his deputies.

Chapter 7. Final Provisions

20. The financing of the Ministry is carried out from the republican budget and other sources not prohibited by law.

21. The liquidation and reorganization of the Ministry occur in accordance with the legislation of the Kyrgyz Republic.

22. In the event of the cessation of activities, the documents of the Ministry are stored in accordance with the law on the National Archival Fund.
