The Enforcement Service of the General Prosecutor's Office of the Kyrgyz Republic explains the procedure for temporary restrictions on citizens' departure from the country.

According to the law, temporary restrictions on departure may be imposed for several reasons, each of which has its own mechanism for removal.

Restrictions imposed by enforcement officers

Enforcement officers have the right to impose temporary restrictions on departure for the following reasons:

1.1. For non-payment of fines for administrative offenses (including fines for traffic violations)

If the decision to collect the fine has entered into legal force and has not been executed within the time frame established by law, the enforcement officer may decide to impose a temporary restriction on the debtor's departure.

To lift such a restriction, the citizen must fully settle the debt. Payment can be made through mobile applications within a day. Information is updated automatically, and the restriction is lifted after full payment.

In addition, citizens can check for debts on the official website — https://suddep.sot.kg/page/debtors, through mobile banking applications, or using a special QR code developed by the Enforcement Service.

1.2. By court decisions on unfulfilled obligations (debts, alimony, taxes, loans, and other monetary claims)

If the court decision has entered into legal force and has not been executed, the enforcement officer has the right to impose a temporary restriction on departure within the framework of enforcement proceedings.

The restriction is lifted in the following cases:

upon full execution of the requirements of the enforcement document;
upon written request of the creditor;
upon full settlement of alimony debts;
upon full settlement of debts on periodic payments;
upon termination or completion of enforcement proceedings in accordance with the law.

The decision to lift the restriction is made by the enforcement officer in accordance with the legislation.

Restrictions imposed by law enforcement and state authorities

It is important to note that the Enforcement Service is not responsible for all possible types of temporary restrictions on departure. In some cases, such restrictions may be imposed by law enforcement or state authorities.

Within the framework of criminal proceedings, during the investigation of cases, law enforcement agencies or the court may impose temporary restrictions on departure to ensure the claim.

For these categories of restrictions, the Enforcement Service does not have the authority. The issue of lifting the restriction is decided exclusively by the authority or court that imposed it.

The Enforcement Service recommends that citizens check for debts in advance before planning trips abroad. Timely fulfillment of obligations will help avoid restrictions and ensure the possibility of free movement.
