Requirements of Judicial Executors for Travel Restrictions
Judicial executors have the right to impose temporary travel restrictions for several reasons:1. Fines and Offenses (including traffic violations).If the decision to collect a fine has become legal and has not been fulfilled within the established time frame, the judicial executor may impose a temporary travel restriction on the debtor.
To lift such a restriction, the debtor must fully pay the debt. This can be done through mobile applications within a day. After payment, the information is updated automatically, and the ban is lifted.
2. Non-fulfillment of Judicial Obligations (debts, alimony, taxes, loans, and other financial claims).If the judicial decision has come into force and has not been executed, the judicial executor may impose a temporary travel restriction. The restriction can be lifted in the following cases:
- upon full compliance with the requirements of the enforcement document;
- upon written request from the creditor;
- upon full payment of alimony;
- upon full fulfillment of obligations for regular payments;
- upon completion of enforcement proceedings in accordance with the law.
Restrictions Imposed by Law Enforcement and Government Agencies
The Service of Judicial Executors is not responsible for all types of temporary travel restrictions from Kyrgyzstan, as such restrictions can also be imposed by law enforcement agencies. For example, within the framework of a criminal case during the investigation or by a court decision during the hearing of a claim, leaving the country may be prohibited.In such cases, the Service of Judicial Executors does not have the authority to lift the ban. The issue of lifting the restriction is decided only by the authority or court that imposed it.
