"I live in the Nariman area of the Kara-Suu district. I have been in and out of courts for 11 years. Since the court decisions are made unfairly, I came here so that my voice could be heard by the esteemed President Sadyr Japarov and the head of the GKNB Kamchybek Tashiev. I have been divorced from my husband S.N. since 1996, who initially borrowed 260,000 soms. This amount was turned into 520,000 and then increased to 780,000 soms. Now they are taking my house. Esteemed President, esteemed head of the GKNB, there will be another court hearing on March 11, we ask you to ensure justice," Badalova said.
Gulchehra Badalova's son, Nuridin Badalov, explained that his father took this debt in 2014, and since then the disputes have not stopped. "In 2014, my father borrowed 260,000 soms, promising to bring cement. I don’t know if he disappeared or just couldn’t repay. The creditor filed a complaint, and my father was sentenced to 6 years. After that, the debt was transferred to my mother, and declaring the amount as 780,000 soms, they took our house. We appealed to Kamchybek Tashiev, but our letter did not reach him—it keeps being redirected to Osh, then to Kara-Suu, and so on in circles. The prosecutor's office responded that everything was legal. Sadyr Nurgozhoevich, Kamchybek Kydyrshaevich, it would be good if you took this case under control. We are ready to pay these 780,000 soms, but for some reason, the creditor is only interested in the house. Our house is worth much more than this amount. We even told the Supreme Court that we would pay the money, even if this debt does not concern us. However, they are not willing to reach a peaceful agreement; they are only interested in the property," he said.
The legal representative of Badalova, Kutman Medetbekov, who has been working on this case for three years, pointed out the legal violations. "There are many unlawful actions in this case. Firstly, despite the existence of a civil court decision regarding R.B. (the ex-husband), a criminal case for fraud was opened on the same fact, and he was sentenced to 6 years. This is double liability for the same act. Secondly, R.B. divorced Gulchehra in 1996. After the divorce, she worked as a migrant abroad and built this house with the money she earned. But the court decided to recover the debt of the ex-husband at the expense of the former wife's property, even though she personally owes the creditor not a single som.
It is also important to note that R.B. passed away in 2022. According to the law "On the Status of Judicial Executors and Enforcement Proceedings," in the event of the debtor's death, the proceedings should be terminated. However, after his death, the case was not closed, and the house, valued at about 8-9 million soms, was illegally assessed at only 1.5 million soms and transferred to cover the debt. We have written to all law enforcement agencies, but there has been no response. Therefore, we are forced to seek help from the president and the head of the GKNB," the lawyer said.
