The Cabinet approved the procedure for conducting state quarantine phytosanitary control

- The Cabinet of Ministers has amended the resolution "On Additional Measures to Ensure Quarantine Phytosanitary Safety" dated February 16, 2024, No. 66, by signing a new resolution No. 60 on February 5, 2026.

A new subparagraph has been added to the document, which establishes the "Procedure for Conducting State Quarantine Phytosanitary Control (Supervision)" (Appendix 5).

This procedure defines the general rules for organizing and conducting inspections, examinations, sampling, and applying control measures regarding quarantine products, vehicles, and wooden packaging.

Control is carried out during the import, export, and transit of quarantine products, their internal circulation and storage, as well as during certification for export and inspection of packaging materials. The phytosanitary risk management system (PRMS) is used in the control process to determine the risk category and level of control intensity.

The document also includes provisions allowing for the delegation of inspections to another official if the cargo is located far away, with mandatory recording of such delegation in a special log.

The requirements for preparing for control describe the verification of documents, comparison of data with the actual characteristics of the cargo, assessment of storage conditions, and mandatory photo and video recording of actions during the opening and sampling.

If signs of infection are detected during the control process, samples are sent to a laboratory, which conducts research within three working days. Upon completion of the research, a decision is made regarding the release or issuance of a certificate, treatment, processing, destruction, or return of the product.

The resolution comes into force 7 days after its official publication. It was published in the "Erkin Too" newspaper on February 6, 2026 (No. 8).

for conducting state quarantine phytosanitary control (supervision)

Chapter 1. General Provisions

This procedure (hereinafter - the Procedure) establishes unified rules for organizing and conducting inspections, examinations, sampling, and applying quarantine phytosanitary control measures regarding quarantine products, vehicles, and packaging materials (hereinafter - quarantine products), controlled by the authorized body for plant quarantine of the Kyrgyz Republic (hereinafter - the authorized body).
The purpose of the Procedure is to ensure the unity of phytosanitary control procedures, enhance the effectiveness of detecting quarantine harmful organisms, and comply with the international obligations of the Kyrgyz Republic within the framework of the Eurasian Economic Union (EAEU) and the International Convention for the Protection of Plants.
The Procedure has been developed in accordance with the Law of the Kyrgyz Republic "On Plant Quarantine," decisions of the Council of the Eurasian Economic Commission in the field of quarantine phytosanitary measures, and other regulatory acts related to phytosanitary requirements.
This procedure is mandatory for all officials of the authorized body involved in phytosanitary control and certification and is also applied in interagency cooperation with other state bodies.
The Procedure is applied in the case of:

1) import, export, and transit of quarantine products;

2) internal circulation and storage of quarantine products;

3) certification of products for export;

4) inspection of vehicles and packaging materials.

The Procedure uses key concepts and definitions:

inspection (examination) act - an official document drawn up by an official of the authorized body based on the results of the inspection of quarantine products and vehicles.

The act records the objectives and location of the inspection, identified violations, measures taken, and the signatures of the official and the representative of the product owner.

The act may be drawn up in written or electronic form and is registered in the information system;

examination of quarantine products - an inspection of quarantine products aimed at identifying quarantine objects and verifying compliance with phytosanitary requirements;

wooden packaging material - packaging and elements made of wood that comply with international phytosanitary standards;

inspection of quarantine products and vehicles - visual inspection at control points;

vehicles - means used for transporting quarantine products;

PRMS - phytosanitary risk management system that determines the risk category.

Chapter 2. Organization of Conducting Inspections (Examinations)

Inspections (examinations) are conducted by an authorized official designated to carry out control activities.
If a batch of quarantine products is located a significant distance from the official, delegation of the inspection to another official closer to the cargo is permitted.
Delegation is recorded in a log, which includes:

1) date and time of delegation;

2) application number;

3) full name and position of the delegating and receiving officials;

4) address of the cargo location;

5) type of delegated activity;

6) date and time of transfer of results.

The person who accepted the delegation is responsible for conducting the inspection and the accuracy of the data.

The results of the inspection (examination) are transmitted to the person responsible for issuing the phytosanitary certificate by any available means.
The territorial department of the authorized body is responsible for maintaining and updating the delegation log.

Verification of the completeness of records is carried out regularly, at least once a quarter, by the head of the territorial department.

The results of the verification are documented in a memo.

Inspections (examinations) of quarantine products are conducted:

1) at phytosanitary control posts;

2) at storage and processing locations;

3) at temporary storage warehouses;

4) at enterprises.

During phytosanitary certification, the inspection is conducted at the actual location of the products. If the presentation of the batch is difficult, the procedure may be conducted on-site.

Costs for organizing and conducting inspections are borne by the cargo owner.

Control of imported quarantine products is carried out jointly with other controlling bodies at border crossing points.

Chapter 3. Preparation for Conducting Inspections (Examinations)

When importing quarantine products, the batch must be registered in the information system of the authorized body.
When moving products from EAEU countries, preliminary data obtained through electronic exchange channels are used.
Before the inspection, the official conducts a documentary check, including:

1) verification of the authenticity of documents;

2) comparison of data with actual characteristics;

3) establishment of import restrictions;

4) verification of compliance with the requirements of the importing country;

5) determination of the category of phytosanitary risk;

6) visual assessment of storage conditions.

In the absence of documents or doubts about their authenticity:

1) for export - certification is halted;

2) for import - release of the product is suspended;

3) the territorial department is notified.

Inspections are conducted in an equipped area ensuring:

1) adequate lighting;

2) necessary tools;

3) personal protective equipment;

4) photo and video equipment.

The products must be arranged in such a way as to ensure free access to the entire batch of cargo.

The cargo owner or warehouse administration is obliged to create conditions for control.

Each action, including opening and sampling, must be recorded in photos and videos.

Chapter 4. Inspection (Examination) of Vehicles

The inspection of vehicles aims to prevent the spread of quarantine harmful organisms and verify compliance with established requirements.

The inspection includes a visual check of:

- the body, container, floor, and other elements;

- cleanliness and sanitary condition;

- compliance with registration data.

Identified contaminations must be eliminated at the expense of the vehicle owner.

Chapter 5. Inspection (Examination) of Quarantine Products

The purpose of the inspection is to identify signs of infection and violations of storage conditions.
The inspection is conducted following these principles:

1) objectivity and sufficiency;

2) visual inspection without damaging the products;

3) in case of suspicion of infection, sampling is allowed;

4) the inspection is conducted while wearing gloves.

The stages of the inspection include:

1) document verification;

2) visual inspection of packaging;

3) inspection of contents.

Seeds and planting material:

1) are subject to mandatory inspection;

2) the inspection includes assessing cleanliness and the presence of pests;

3) samples are sent to the laboratory;

4) until a conclusion is received, the batch is detained;

5) in case of infection, measures are taken.

Wood is checked for labeling and signs of infection.

In the absence of labeling or infection, it is subject to treatment or destruction.

Cereal and leguminous crops are assessed for the presence of pests and signs of damage.
Fruits and vegetables are checked for rot and damage.
Plant feeds are checked for cleanliness and absence of pests.
In case of non-compliance with the phytosanitary certificate, the batch is subject to an import ban.

In case of non-compliance during certification, a refusal is issued until violations are rectified.

In case of discrepancies in the vehicle number, a decision is made regarding the return or destruction of the batch.
The results of the inspection are recorded in an act, which includes:

1) date and place of inspection;

2) information about the products;

3) document details;

4) identified violations;

5) decisions on further actions.

One copy of the act is issued to the cargo owner, and the second is sent to the archive.

Documents are kept for at least three years.

Chapter 6. Inspection (Examination) of Quarantine Products

The inspection of quarantine products is conducted to confirm infection and is appointed when there are grounds.

1) identification of signs of infection;

2) receipt of products from unfavorable regions;

3) discrepancies in information in documents;

4) absence of a certificate or its forgery;

5) indication of a high level of phytosanitary risk;

6) necessity for laboratory confirmation.

The decision to conduct the inspection is recorded in the act.
The inspection includes sampling for expertise.

The quantity and method of sampling are determined by the official according to the requirements.

The inspection is conducted in the presence of the owner with photo and video recording.

The selected samples are placed in airtight packaging with appropriate labels.

The official has the right to conduct a preliminary examination of the samples on-site during the inspection, provided conditions are met.

A preliminary examination is not conducted if laboratory analysis is required.

The results of the preliminary examination are reflected in the act.

Delivery of samples to the laboratory is carried out by:

1) the official;

2) the cargo owner;

3) the authorized organization.

The laboratory registers the samples and conducts research within the established timeframes.

The conclusion is signed by the head of the laboratory and sent to the official.
Based on the conclusion, one of the following decisions is made:

1) permission for product release;

2) treatment of the product;

3) processing of the product;

4) destruction of the product;

5) return of the product.

All decisions are formalized in acts and recorded in the information system.

Chapter 7. Documentation of Results

All results of inspections and laboratory studies are documented in established forms.
Documentation must ensure transparency of the actions of the official.
All acts and conclusions are subject to registration in the information system.
Each document is accompanied by:

1) copies of signed originals;

2) photo and video materials;

3) laboratory conclusions in PDF format.

Records are confirmed by an electronic signature.
The original documents are stored in the archive for at least three years.
Electronic versions of documents are stored indefinitely.
Destruction of paper documents is allowed only after the expiration of the storage period.
The territorial department submits a monthly report on conducted inspections.
In case of detection of quarantine objects, the department informs the authorized body.

At the end of the year, an analytical report is formed, including risk analysis and assessment of control effectiveness.
The results of the analysis are used to prepare proposals for improving the regulatory framework.

The procedure is accompanied by documents and tools for systematizing control:

1) inspection act form;

2) delegation log;

3) order form;

4) label for the safe package;

5) list of recommended equipment for sampling.

Based on the inspection of quarantine products and the inspection of the transport vehicle, a

decision was made: to refuse/to issue a phytosanitary certificate/to conduct an inspection/to send for disinfection.

Guided by GOST 12430-2019 "Plant Quarantine. Methods and Norms for Sampling

Quarantine Products," inspections of quarantine materials and sampling of average

samples (probes) were conducted to establish the quarantine phytosanitary condition:
