Prosecutor General's Office: The Introduction of Private Bailiffs Poses No Risks

During the meeting of the committee on judicial and legal issues, law enforcement, combating crime, and countering corruption of the Jogorku Kenesh, a draft law on the introduction of the institution of private bailiffs was discussed. Deputy Ulukbek Uzakbaev expressed concerns about certain risks associated with this reform.

Uzakbaev emphasized the need to increase the accountability of private bailiffs. He noted that the transfer of several state functions, such as arrest and travel bans, could lead to negative consequences. The parliamentarian called for stricter oversight by the General Prosecutor's Office regarding the qualification requirements for private bailiffs to avoid the commercialization of this process. "For example, it is not excluded that someone might turn to private bailiffs for a travel ban," he added.

In response to these remarks, Deputy General Prosecutor Umutkan Konkubaeva assured those present that the supervisory authority would closely monitor the activities of private bailiffs.

"This institution is being created in accordance with the decree of President Sadyr Japarov. We have analyzed the experience of other countries and are confident that it poses no risks. Citizens will be able to choose whether to turn to private or state bailiffs. The Prosecutor's Office will exercise strict control. We have also established a minimum age for private bailiffs—25 years—to ensure professionalism," she noted.

It should be noted that the draft law of the General Prosecutor's Office "On Amendments to Certain Legislative Acts in the Field of Enforcement Proceedings" proposes the introduction of the institution of private bailiffs and strengthens the responsibility for alimony debtors.
