Deputy on the introduction of arrest for alimony debtors: Will half of the men in Kyrgyzstan be detained?

At the meeting of the Jogorku Kenesh on February 4, Deputy Kubanychbek Samakov expressed the opinion that if arrests of alimony debtors begin, there will not be enough places in temporary detention facilities in the country.

Deputy Attorney General Umutkan Konkubaeva noted that the draft law implies punishment for evading alimony payments based on a court decision if the debt exceeds three consecutive months or one year. In this case, an arrest for three days is provided.

For repeated violations, an arrest for seven days is provided.

A person who has paid off all debts is exempt from liability.

Private bailiffs will also be able to demand the enforcement of enforcement documents.

Samakov asked about the number of alimony debtors in the country. Konkubaeva replied that in 2025, bailiffs received 60,720 enforcement orders, but this does not mean that all of them are malicious non-payers, as some individuals may have multiple documents.

The deputy emphasized that with the introduction of the new law, the number of debtors could increase fivefold.

“Will half of the men in Kyrgyzstan end up under arrest? I understand the need for accountability, but is it possible to apply other measures, such as property seizure or travel bans? We will not be able to cope with such a number of detainees,” noted Samakov.

The Deputy Attorney General responded that the interests of children should be taken into account first and foremost. According to her, measures should be applied to those who do not pay alimony for a year.

“First, they receive ten days for voluntary repayment of the debt, after which funds in their accounts may be seized, and they will be prohibited from leaving the country. Last year, 1,124 criminal cases were initiated,” she added.

“The number of arrests will increase fivefold. Prepare for this,” the deputy concluded.
