Conviction for Alimony: Dastan Bekeshev Believes That Fathers' Debts Will Impact Children

Deputy Dastan Bekeshev expressed concern about the possible consequences of introducing criminal liability for alimony non-payers. He shared his opinion at a meeting of the Jogorku Kenesh while discussing a bill proposed by the General Prosecutor's Office.

Within this document, it is proposed to establish criminal liability for those who evade alimony obligations.

“Bringing men to criminal responsibility for non-payment of alimony may negatively affect their children. For example, if a father has a criminal record, his child may face difficulties when trying to get a job in law enforcement agencies. Thus, the father not only fails to provide for his child but also creates additional obstacles for their future,” noted Bekeshev.

Deputy General Prosecutor Umutkan Konkubaeva added that criminal liability will only apply to those citizens who have not fulfilled their alimony obligations for a year. Prior to that, they will be subjected to administrative measures, including a three-day arrest, if they do not meet their obligations within three months.

Another deputy, Kubanychbek Samakov, also opposed the introduction of criminal liability, pointing to the potential increase in the number of complaints against alimony non-payers. “If there are currently 60,000 such citizens, after the law is passed, their number could rise to 300,000. We risk overcrowding the prisons. There is a possibility that the law will not work,” he said.

Samakov suggested considering alternative measures, such as property seizure, travel bans, and restrictions on civil transactions.

As a result of the discussions, the deputies adopted the General Prosecutor's bill “On Amendments to Certain Legislative Acts in the Field of Enforcement Proceedings” in the first reading. This document introduces the institution of private bailiffs and strengthens penalties for alimony non-payers.
