The Ombudsman of Kyrgyzstan reported that employees of the institute were denied access to the territory of the Temporary Detention Center for Foreign Citizens twice.

The Ombudsman reports that twice the staff of the institute were denied permission to enter the Temporary Detention Center. According to her, this is a direct violation of the constitutional law that guarantees unhindered access to places of forced detention and accountability for denying such access.

The Ombudsman Institute views the systematic refusals as a troubling signal of possible attempts to conceal violations of the rights of detainees in the center.

On October 28, representatives of the institute attempted to monitor the conditions of detention of foreign citizens; however, they were denied access to the center by the controlling authorities. As a result, a report was drawn up and submitted to the General Prosecutor's Office.

The military prosecutor's office responded to this appeal by sending a representation to the authorized body to eliminate violations of the law. Ultimately, one of the officials faced disciplinary action.

Only on November 3, 2025, did the Akıyqatçı Institute manage to conduct monitoring in the center, during which serious violations regarding the conditions of detention and the rights of foreign citizens were recorded.

At the time of the inspection, there were 160 people in the center. The sanitary conditions leave much to be desired: the toilets are closed, and only three portable toilets are installed in the yard.

The building of the center consists of two blocks, which lack a heating system, and air conditioners work only in four rooms, while the other rooms are cold.

The outdoor showers are makeshift and represent temporary structures.

Moreover, detainees prepare food themselves outside, despite the presence of a designated cook, indicating a failure to fulfill obligations to provide safe and balanced nutrition.

It should also be noted that detainees are deprived of access to legal assistance and means of communication, as their mobile phones have been confiscated, violating their right to communicate with lawyers and relatives.

This contradicts Article 61 of the Constitution of the Kyrgyz Republic and Article 13-1 of the Law of the Kyrgyz Republic "On Guaranteed State Legal Assistance," which grants the right to qualified legal assistance to foreign citizens and stateless persons.

As a result of the monitoring, an official appeal was sent to the Cabinet of Ministers of the Kyrgyz Republic with a recommendation to take comprehensive measures to eliminate the identified violations.

In December 2025, the Akıyqatçı Institute received a complaint from the lawyers of the detainees, after which the staff went to the center again. However, they were once again denied a meeting with the applicants and monitoring, and at the checkpoint, they were required to obtain additional permission.

A report on the repeated obstruction of the activities of Akıyqatçı was drawn up and also sent to the General Prosecutor's Office.

In light of the above, the Ombudsman Institute appeals to the Ministry of Internal Affairs to take measures against officials who obstruct the lawful activities of Akıyqatçı and ensure transparency in the operations of the Temporary Detention Center.
