According to information, an investigator from the Karakol City Police Department decided to apply this measure to two suspects. Special electronic bracelets were installed on the detainees by employees of the monitoring department of the Ministry of Justice, and a mobile application was also used for control.
Electronic monitoring is a device that allows tracking a person's movements while imposing restrictions on their freedom. The bracelet is worn for an extended period, cannot be removed without permission, and monitoring is carried out through a mobile application developed by the Ministry of Justice.
The main objectives of using electronic monitoring are:
— to monitor compliance with established prohibitions and restrictions for the accused;
— remote observation and monitoring.
However, this measure is not applied in the following cases:
— in cases of particularly serious crimes;
— in cases of serious crimes provided for in Section VI of the Criminal Code of the Kyrgyz Republic.
The decision to introduce electronic monitoring is made by the following persons:
— investigator, prosecutor, investigative judge, or court;
— based on a petition from the suspect, their defender, or legal representative.
The decision document must specify:
— the territory outside of which the accused is not allowed to be;
— all restrictions and prohibitions;
— the authority or employee responsible for monitoring compliance with the conditions.
The accused is obligated to:
— not leave the established territory without the bracelet;
— comply with established prohibitions and restrictions;
— not interfere with investigative and judicial actions;
— appear upon summons within the specified time.
In case of violation of the conditions of electronic monitoring, the accused may be assigned another preventive measure.
This innovation has become the first experience in implementing a mechanism aimed at ensuring public safety while respecting human rights within the legal framework.
