The rules of notarial activity have been updated in Kyrgyzstan

The Ministry of Justice of the Kyrgyz Republic has presented updates to the rules of notarial activities, which were officially approved by the Government Resolution of the KR No. 121 dated February 19, 2026.

According to the new requirements, the fee for notarial actions must now be paid through the payment platform integrated with the Unified Information System of Notaries (EISN) on the day of the notarial act and the issuance of legally significant documents. Payment will be recorded in the system, confirming its completion. A standard has also been established, according to which the text of the notarial inscriptions must be generated exclusively through the EISN.

Clarifications have been made regarding certain agreements, such as prenuptial agreements, surrogacy agreements, agreements for the transfer of a child to a foster family, as well as alimony agreements. All these documents must be concluded in person by the parties, excluding the possibility of execution through representatives.

Consent for a minor to travel outside the country is now issued for a specific period if the travel is undertaken without accompaniment or with one of the parents (guardian, caretaker).
Changes have also included the rules for issuing notarial orders. The requirements for cases where enforcement is carried out based on a notarially certified transaction, a simple written form, as well as for alimony for minors, provided there are no disputes regarding paternity or maternity, and for mandatory payments, excluding taxes and insurance contributions, are now clearly defined.

Additionally, the procedure for notifying debtors has changed. A copy of the notarial order must be sent within one day, but now the notary can use not only postal services with notification but also electronic means of communication, such as PDF files via email, WhatsApp, Viber, or Telegram.
These changes will come into effect ten days after their official publication.

Earlier, reforms in the notarial sphere were also carried out, including the launch of remote notarial services for citizens abroad through the "Electronic Notary" system, expanding the accessibility of this service, as well as a pilot project of the AIS "Electronic Apostille" with a full cycle of online service. Furthermore, from October 1, 2025, remote execution of a number of notarial actions and an increase in qualification requirements for private notaries in inheritance cases are planned, which will contribute to the integration of Kyrgyzstan's notariat into the international professional community.
