Law on Silence: Housing Committees May Be Allowed to Draft Noise Protocols

The Ministry of Internal Affairs of Kyrgyzstan has prepared amendments to the Code of Offenses, as well as to the laws "On the Basics of Crime Prevention" and "On Silence." The deputies discussed the proposed bill at a meeting of the committee of the Jogorku Kenesh, which deals with issues of law and order and combating crime.

According to Deputy Minister of Internal Affairs Oktobur Urmambetov, previously the responsibility for enforcing the silence law rested with the Ministry of Health, specifically with the Department of Health Prevention and Sanitary-Epidemiological Surveillance.

Now, as Urmambetov clarified, new powers are proposed to be granted to both law enforcement agencies and local self-government, which will allow them to respond to citizens' complaints about noise and to issue protocols.

In addition, individuals managing apartment buildings will also be granted the right to conduct preventive measures and, in case of violations, to draw up acts for submission to state authorities.

In response to deputies' questions, Urmambetov reported that the current legislation already provides for fines for noise: 10,000 soms for individuals and 28,000 for legal entities. He added that if necessary, the issue of increasing fines could be considered.

The bill also includes a provision that allows for non-compliance with the silence norms during the New Year holidays from 10:00 PM on December 31 to 3:00 AM on January 1.

Representative of the Ministry of Health Ryspek Sydygaliev noted that noise inspections are conducted using special equipment.

“We have three types of sound level meters that we use to measure noise levels. However, we need another 16 units of equipment. This year we received 62 complaints about noise from ventilation and 79 complaints related to musical instruments and construction work. We drew up 30 protocols and imposed fines totaling 604,000 soms,” said Ryspek Sydygaliev.

The deputy minister added that last year, 23 cafes and nightclubs were fined for violating the silence law.

After the discussion, the committee members unanimously supported the bill in the first reading.

The "On Silence" law was signed in December 2024. The initiator of this law was deputy Dastan Bekeshev, aimed at protecting the health of citizens from the harmful effects of noise and sound pressure exceeding permissible norms.
