The draft of the new Constitution also states that the president must announce elections to the Kurultai within a month and hold them within two months after the Constitution comes into force.
According to Article 94, the new Constitution, approved in a republican referendum, will come into effect on July 1, 2026, the same day the current Constitution will cease to be in effect.
The day of the adoption of the new Constitution will be celebrated as a state holiday — Constitution Day of the Republic of Kazakhstan.
Within two months after the start of the first session of the Kurultai of the first convocation, the president is required to appoint a vice president with the consent of the deputies, as well as the chairman and judges of the Constitutional Court, members of the Central Election Commission, and the Supreme Audit Chamber. At the same time, the current chairman and judges of the Constitutional Court, as well as members of the CEC and the Supreme Audit Chamber, appointed under the Constitution of August 30, 1995, will retain their powers until the new composition is formed.
Within two months after the Constitution comes into force, the chairman of the Supreme Court, the chairman of the National Bank, the prosecutor general, the chairman of the National Security Committee, and the chairman of the Supreme Judicial Council, as well as the ombudsman for human rights, must be appointed.
Judges of the Supreme Court, local and other courts, as well as deputies of maslikhats and other officials elected or appointed under the Constitution of August 30, 1995, will continue to perform their duties until the circumstances provided for by the Constitution and laws for the termination of their powers arise.
