Expert Identifies Key Risks for Employers When Hiring Employees

- On the "Aysalyk" platform, tax lawyer Kanybek Cherikov held a discussion with labor law expert Eldar Tajibaev, during which key points were highlighted that employers should pay attention to when hiring employees.

According to Tajibaev, the first thing to check is the presence of a passport. Without this document, the employer does not have the right to hire a person. The expert cited cases where candidates started working "temporarily without a passport," only to later find out that they were foreigners. In such cases, the employer may face serious consequences for illegal employment.

The second important aspect concerns education and professional qualifications. Tajibaev noted that sometimes applicants provide copies of diplomas with the promise to "bring the original later," and it later turns out that the documents are fake. A similar threat arises with licenses and certificates necessary for performing high-risk work: if an employee is allowed to work without the required permits and an accident occurs, the responsibility may fall on the employer.

The third important point is the employment record book. The expert emphasized that if an employee claims to have an employment record book but will bring it later, the employer should not delay the registration process — it is better to create a new one immediately and maintain personnel documents correctly from the first working day.

Additionally, Tajibaev reminded about the necessity of conducting medical examinations and obtaining certificates in cases where it is required by the nature of the work, especially in high-risk areas or when working with children. These requirements should be clearly outlined in the employer's local regulations.
