The Ministry of Justice proposes to legalize digital evidence in criminal proceedings

A new draft law has been developed in Kyrgyzstan, aimed at integrating digital evidence into criminal and procedural legislation, which aligns with modern digital trends.

The Ministry of Justice reports that the draft includes amendments to the Criminal Code, the Criminal Procedure Code, and the Code of Offenses. These amendments are aimed at the official recognition of digital evidence and the establishment of procedures for their collection, storage, documentation, and use in criminal proceedings.

Particular attention will be paid to the protection of citizens' rights, including procedural guarantees when dealing with personal data, correspondence, and privacy issues, as well as the introduction of judicial control mechanisms.

The draft law also aims to eliminate outdated terminology to align it with the Digital Code of the Kyrgyz Republic, and introduces legal norms for working with virtual assets, which are increasingly becoming targets for criminals.

The adoption of this draft law will create a modern legal framework for combating cybercrime, establish clear rules for handling digital data, and ensure uniformity in law enforcement. This will enhance the protection of citizens' rights and improve the effectiveness of investigations into crimes committed using the internet and digital technologies.
