These amendments are being developed in accordance with the Law "On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors," with the aim of improving state control over the circulation of such substances.
The draft proposes to expand the list of controlled substances.
Four new substances from the synthetic opioid group related to the nitazene series are planned to be added to List I of narcotic drugs, which are subject to restricted circulation and special control:
- N-pyrrolidino protonitazene;
- N-pyrrolidino metonitazene;
- N-desethyl-isotonitazene;
- etonitazepipn.
List II of psychotropic substances, also subject to restricted circulation and special control measures, will include:
- hexahydrocannabinol (HHC/ГГК);
- lisdexamfetamine.
Additionally, List III of psychotropic substances, which are subject to restricted circulation and general control measures, is proposed to be supplemented with:
- carisoprodol.
It is also planned to add new items to the list of analogues of narcotic drugs and psychotropic substances, including 4-BMC (brefedrone), 4F-PBP, 4F-PHP, and a number of other compounds.
The amendments also concern the table of substance quantities relevant for classifying actions under the articles of the Criminal Code and the Code of Offenses. The following threshold values are proposed for the new items:
- for nitazenes — 0.1 grams (small size), 0.1–3 grams (large), 3 grams (especially large);
- for lisdexamfetamine — 0.1 grams / 0.1–3 grams / 3 grams;
- for HHC — 0.2 grams / 0.2–6 grams / 6 grams;
- for carisoprodol — 0.05 grams / 0.05–1.5 grams / 1.5 grams.
The explanatory note states that Kyrgyzstan, as a participant in international conventions on the control of narcotic and psychotropic substances, is obliged to update its national lists. It also mentions the decisions of the Commission on Narcotic Drugs and the work of the early warning mechanism for new drugs and psychoactive substances.
