According to the explanatory note, an analysis of the current legislation revealed inconsistencies in the terms related to narcotic and psychotropic substances. In this regard, the draft law proposes to update outdated formulations and unify legal norms.
The proposed changes are as follows:
- In the Civil Procedure Code, it is planned to replace the term "narcotic substances" with a broader term — "potent substances, narcotic drugs, psychotropic substances, and their analogues and precursors." This affects Articles 290 and 291, which define the grounds for recognizing a citizen as partially capable.
- The Code on Children will be supplemented with new formulations in the list of prohibited types of labor for minors — instead of "narcotic and toxic substances," a more precise definition will be provided, covering potent substances and their analogues.
- The Law on Advertising also proposes to introduce a ban on the advertising of potent and psychotropic substances, as well as precursors, expanding the existing list of prohibited goods.
These changes have been developed in accordance with the resolution of the Jogorku Kenesh dated January 31, 2024, which aims to combat the illegal trafficking of synthetic drugs among youth.
The authors of the draft law emphasize that the proposed changes will not lead to social or economic consequences, will not require additional budget expenditures, and will not affect entrepreneurial activities. The main goal is to legally adjust the terminology and strengthen measures to prevent the abuse of dangerous substances.
