This law was adopted by the Jogorku Kenesh of the Kyrgyz Republic on January 22, 2026. Its main goal is to ensure the effective and rational use of budgetary funds at both the republican and local levels when conducting the procurement of goods, services, and works.
According to the new provisions, procurements related to the organization of international events at the state level, which involve high-ranking officials such as the President of the Kyrgyz Republic, the Speaker of the Jogorku Kenesh, and the Prime Minister, are not subject to the law "On State Procurement." These procurements will be carried out through civil law transactions between the customer and the contractor in accordance with the civil legislation of the country.
The law also introduces the term "state assignment," which refers to an order financed from the republican and local budgets to legal entities with state participation in the authorized capital. These assignments are aimed at fulfilling priority state tasks that contribute to socio-economic stability and socio-cultural development.
Procurements conducted under the state assignment are also not regulated by the existing law "On State Procurement" and are carried out through civil law transactions between state customers and contractors, specifying the indicators of expected results. This law is designed to promptly address tasks related to procurement in specific sectors funded by budgetary resources.
According to the provisions of the law, both the state customer and the contractor of the state assignment bear personal responsibility for the targeted and effective use of allocated budgetary funds in the process of executing the state assignment.
