At the meeting of the Jogorku Kenesh, the deputies also discussed the draft law "On Amendments to the Law of the Kyrgyz Republic on Public Procurement," which was adopted in three readings.
The initiator of the draft law is the Chairman of the Cabinet of Ministers.
The details of the draft law were presented by the Minister of Economy and Commerce, Bakyt Sydykov.
According to him, the proposed changes will help optimize and simplify the processes of public procurement. The draft law introduces the concept of a state assignment, which will allow for more effective resolution of important and strategic tasks of the state. Thus, improving the legal regulation in this area will contribute to the sustainable development of the country and strengthen its institutional structure.
According to the new document, conducting competitions and transparent procedures will become optional. State assignments will be carried out by legal entities with state participation. The draft law also provides the opportunity for the general contractor to transfer up to 50% of budget funds to subcontracting companies, which may reduce the level of direct competitive control over these funds.
Among the areas that can be transitioned to a new funding format are:
- construction, repair, and maintenance of roads of international and republican significance;
- education, science, and healthcare;
- culture, tourism, and preservation of historical heritage;
- modernization of fixed assets and development of various sectors of the economy.
In addition, special rules are provided for the operation of the President's Office and the organization of official events with the participation of the head of state, the speaker, the chairman of the Cabinet of Ministers, and foreign delegations.
During the discussion, Deputy Suyunbek Omurzakov clarified that Article 2, Paragraph 5 of the law on public procurement states that amendments to this law may be made no more than once a year.
Deputy Dastan Bekeshev raised questions regarding the definition of subcontractors, expressing concerns about potential corruption risks in their selection, as well as the interaction between state enterprises and private companies.
In turn, Deputy Kunduzbek Suimanov supported the proposed norms, emphasizing that the draft law aims at the effective and reasonable use of funds from the republican and local budgets in the process of public procurement.
Deputy Mederbek Aliyev added that the proposed changes meet modern requirements, noting that when conducting tenders, the purchasing organization often focuses on low cost, which can negatively affect the quality of the purchased goods, works, and services.
