The Parliament supported increasing the responsibility of drivers for drunk driving

Today, at a parliamentary meeting, deputies approved in the first reading a bill concerning amendments to various legislative acts aimed at improving road safety. The initiative was put forward by the Cabinet of Ministers.

Deputy Minister of Internal Affairs Oktay Urmambetov noted that the proposed changes imply stricter liability for drivers operating vehicles under the influence of alcohol, drugs, or other psychoactive substances. In the event of a traffic accident with casualties, the possibility of exemption from criminal liability by agreement with the victim is excluded.

In addition, the bill proposes to revise the penalty system for offenses committed while intoxicated, introducing harsher prison terms and excluding the possibility of probation for those convicted of serious traffic violations while under the influence.
The bill also clarifies the procedure for applying an additional penalty related to the deprivation of the right to drive a vehicle, making it mandatory for all crimes related to violations of traffic rules.

In this regard, a new legal mechanism for enforcing such punishment is introduced, which clearly defines the timelines, the procedure for confiscating driver's licenses, as well as their storage and return after the deprivation period.

Tightening sanctions for operating vehicles under the influence also implies changes to the Code of Offenses, increasing the maximum detention period to 20 days, instead of the current seven. It is also proposed to exclude drivers who violate the law under the influence of alcohol from those who can avoid arrest.

Changes are also planned regarding the temporary confiscation of driver's licenses and the conditions for retaking the traffic rules exams according to established legislative rules.
Furthermore, the bill amends the rules of liability for exceeding the average speed in areas where photo and video surveillance cameras are installed, as well as strengthens liability for drivers refusing medical examination.

Within the framework of this bill, mopeds will be equated to mechanical vehicles, which implies their mandatory registration with the authorized bodies. A requirement for a driver's license to operate a moped of category A1 is also introduced.

As Urmambetov explained, this is necessary for the implementation of mandatory state registration of mopeds.

“Currently, registration is only required for mopeds with an engine displacement of more than 50 cubic centimeters, a maximum design speed exceeding 50 kilometers per hour, or a carrying capacity of more than 500 kilograms (with an electric motor). Due to the lack of registration for mopeds and their inability to be identified, some individuals violate traffic rules with impunity, creating a threat to the safety of other road users,” he added.

Deputies emphasized the importance of tightening requirements for drivers under the influence and those who resist the work of the traffic police. The deputies also called for regulation of the use of scooters, mopeds, and scooters to avoid problems during their operation.
