Government Services in Kyrgyzstan Aim to Simplify and Partially Outsource

As reported by Choro Seyitov, Deputy Minister of Economy and Commerce, the initiative is aimed at optimizing current procedures, as well as revising the rules regarding paid services and their outsourcing.

The following changes are proposed:

1) Simplification of requirements for the standards of state and municipal services.

The current version of the law contains up to 18 mandatory requirements. The new draft law proposes to reduce this list to 8 key points, including the name of the service, methods of provision (including electronically), a list of necessary documents, deadlines for execution, forms of results, the procedure for determining the cost of paid services, and the process for appeal.

2) Clarification of the rules for providing paid services.

According to the new proposals, services provided beyond the established state order or quotas funded from the budget will be considered paid. The draft law also emphasizes that services whose free provision is enshrined in the Constitution and international obligations of Kyrgyzstan will remain free of charge.

3) The possibility of setting prices for services above their cost.

According to the current version of the law, the cost of services is calculated based on their cost. The new draft law proposes to allow the establishment of prices above cost for certain services, taking into account expenses for creating reserves, modernizing the material and technical base, improving qualifications, and motivating employees. It is specifically stated that consular services will be regulated according to a specific procedure.

4) Revision of the administrative regulations for service provision.

A comparative analysis presents an article concerning the administrative regulations, which should describe the procedures, timelines, interaction procedures, and other aspects of service provision.

5) Change in the outsourcing mechanism for services.

Currently, the transfer of state and municipal services to private individuals is carried out in accordance with the legislation on public procurement. The new draft law proposes to change this procedure, allowing the transfer of services or individual stages according to rules approved by the Cabinet of Ministers, without the need to follow the public procurement mechanism.

At the same time, control over the activities of private contractors will be carried out in two directions:

• setting prices and applying tariffs,

• compliance with the standards of state and municipal services.
