Responsibility for drunk driving in Kyrgyzstan is planned to be tightened

At today's meeting of the relevant committee of the Jogorku Kenesh, the Deputy Minister of Internal Affairs of the Kyrgyz Republic, Oktobyr Urmambetov, presented a new draft law concerning changes in legislation aimed at ensuring road safety. This project was developed in accordance with the decree of the President of the Kyrgyz Republic dated December 7, 2021, No. 548, and is aimed at reducing the number of road traffic accidents and their serious consequences.



The document includes proposals to amend the Criminal Code, the Criminal Procedure Code, the Code of Administrative Offenses, as well as the Law "On Road Traffic in the Kyrgyz Republic." The main goal of these changes is to tighten responsibility for drivers who operate vehicles under the influence of alcohol, drugs, or other intoxicants.

As noted at the meeting, these measures are intended to enhance road safety and reduce the level of crimes and offenses. In particular, it is proposed to strengthen responsibility for violations of traffic rules that lead to serious consequences, including loss of life. In such cases, drivers will not have the opportunity to avoid criminal liability through reconciliation with the victims, and the application of probation for those convicted of such offenses will also be prohibited.

In addition, the draft law provides for mandatory imposition of additional penalties for traffic violations. A new mechanism for the enforcement of penalties is introduced, which defines the procedure for the seizure, storage, and return of driver's licenses after the expiration of the driving ban.

Changes to the Code of Administrative Offenses also include an increase in the term of administrative arrest for driving under the influence to 20 days. Responsibility for exceeding the average speed in the areas monitored by cameras is introduced, and penalties for refusing to undergo medical examination are also strengthened.

The draft law provides for the temporary seizure of driver's licenses with mandatory retaking of exams on traffic rules. New terms will be added to the Law "On Road Traffic" that define the responsibilities of vehicle owners regarding their registration, as well as grounds for refusal of registration. The use of unregistered vehicles will be prohibited, and age restrictions and requirements for driving experience will also be established.

Separately, the draft law proposes to equate mopeds to mechanical vehicles, which implies their mandatory registration and the possession of a category "A" driver's license. The developers believe that such measures will help improve discipline among moped drivers and enhance the overall situation on the roads.
