According to Determann, the EU has become one of the first regions to implement such restrictions, starting with the harmonization of legislation in 1995. This initiative aims to create a single market where companies can exchange data for business purposes while preventing their exit beyond this market.

“The EU has urged other countries to adapt their legislation to improve trade relations, allowing them to recognize the adequacy of these countries within various trade agreements, including recent ones with Japan and Korea, as well as discussions with Brazil,” noted the professor.

Thus, data transfer restrictions function as measures regulating trade between countries, emphasizes the expert.
