It has been established that in 1996, the kindergarten building, occupying an area of 533.3 sq.m, along with a land plot of 2200 sq.m, was unlawfully transferred into private hands of the joint-stock company "Nur-KM." This occurred in violation of the decree of the President of the Kyrgyz Republic No. UP-37, which was in effect at that time and prohibited such transactions.
According to this decree, social infrastructure facilities could not be sold by either state or privatized enterprises, regardless of the state's share in their capital, if they were on their balance sheet or were transferred free of charge during the privatization process, provided that their intended purpose was preserved.
After the conducted measures, the owner of the building, realizing the illegality of his ownership, agreed to return the kindergarten and the land plot to the state.
