The deputy asked how the amendments to the Criminal Code of the Kyrgyz Republic will be applied using the example of detained security officials.

Today, during the meeting of the Jogorku Kenesh, amendments to several codes were discussed in the framework of the second reading, among which was the return of the concept of recidivism to legislation.

One of the most debated provisions of the bill concerned the addition to Article 50 of the Criminal Code, which implies that "causing harm is not considered a crime if it is carried out in the lawful performance of duties prescribed by the position, or for the purpose of protecting the sovereignty of the state."

During the discussion, Gulya Kozhokulova expressed doubts about the appropriateness of this provision, pointing to situations involving criminal cases against employees of the State Committee for National Security (GKNB).

She posed a question to representatives of the Prosecutor General's Office: "How can you explain this article? Given the recent events involving the initiation of criminal cases against the leadership of the GKNB, who will determine the legality of orders that may be executed unlawfully?"

In response, Deputy Prosecutor General Umutkan Konkubaeva stated that the discussed amendment had been excluded from the bill.

"The Prosecutor General's Office is not the initiator of this bill. It is important to note that during the second reading, this provision was excluded, and only the previous version remains," Konkubaeva explained.
