
According to a new bill presented by the government of Russia to the State Duma, updated rules will be introduced for the children of foreign citizens working under a patent. The documents propose changes to the existing federal law "On the Legal Status of Foreign Citizens in the Russian Federation."
Under this initiative, the children of labor migrants will be allowed to stay in the country only for the duration of their parents' patent, which will only be possible if a fixed advance payment of personal income tax is made for both the worker and each child.
Upon reaching the age of 18, such individuals will be required to either leave Russia or obtain legal grounds for their stay within 30 days, including applying for a patent.
However, this requirement will not apply to foreign citizens who have other legal grounds for being in the country. Such grounds include having a temporary residence permit, a residence permit, as well as student or worker status as provided by Russian legislation.
The explanatory note to the bill emphasizes that the proposed changes are aimed at preventing cases of uncontrolled stay in Russia by individuals who are no longer minor dependents of foreign workers.
Additionally, the bill introduces new conditions for the issuance of patents. It may be denied if information about the foreign citizen is absent from state information systems or if their income is below the subsistence minimum established for them and their family members.
