Kassym-Jomart Tokayev emphasized that the opinions of professional lawyers regarding the Constitution indicated the need to clarify a number of its provisions. In particular, he noted the importance of discussing the procedure for presidential elections in situations where the president cannot fulfill his duties due to unforeseen circumstances.
At the same time, the president reminded that according to the current Constitution, in the event of the president's resignation, his powers are transferred to the chairman of the Senate.
“If the chairman of the Senate is also unable to fulfill his duties, then the powers should be transferred to other officials, according to the established procedure. It is important to note that the concept of 'remaining term' can vary from six months to six years. Therefore, it is necessary to clarify the fundamental law by stipulating a provision for holding extraordinary elections within two months in the event of the president's early departure,” Tokayev added.
According to the head of state, this aligns with international practice. Every president must come to power legally, through elections. This, as Tokayev assured, is a fundamental principle that should remain unchanged for future presidents.
