Activists in Bishkek Challenge Restrictions on Rallies

In Kyrgyzstan, the judicial proceedings regarding the provisions of the Law "On Peaceful Assemblies" continue, which, according to the activists, violate their right to freely hold rallies without unjustified restrictions.

On December 23, 2025, activists Tolekan Ismailova and Bermet Borubaeva filed a petition with the Constitutional Court, demanding that certain provisions of part 2 of Article 14 and part 2 of Article 15 be declared unconstitutional. These provisions allow local authorities to restrict the location, time, and route of peaceful assemblies, effectively establishing prolonged territorial bans.

The applicants emphasize that such practices contradict Article 39 of the Constitution and the international obligations of Kyrgyzstan, including Article 21 of the International Covenant on Civil and Political Rights.

The Constitutional Court rejected the petition on January 26, 2026, citing formal deficiencies. However, the court did not specify which particular provisions of the law on the Constitutional Court were violated, which the activists view as an obstacle to access to constitutional justice.

In response to the rejection, on February 2, they filed a complaint requesting a reconsideration of the case and the opportunity to participate in the process.

It is worth noting that in January 2026, the Pervomaisky Court extended the ban on rallies in the center of Bishkek until March 31, 2025. There remains only one location in the capital for holding protest actions — the Maxim Gorky Park.
