According to the initiator, the Constitution and the Civil Code guarantee every citizen the right to own, use, and dispose of their property, including the ability to bequeath it to individuals who are not related by blood.
However, as the deputy points out, in practice there are gaps in the legislation that unjustifiably restrict citizens' rights to inherit by will simply because they are not close relatives.One example is the situation where a citizen cannot obtain a death certificate of the testator from a notary, as government authorities refuse to issue this document, citing the Law "On Civil Status Acts" and the lack of a familial relationship.
Thus, in such cases, the rights of both heirs who are not close relatives and the testators themselves, who wish to leave their property to those dear to them, are violated.
To rectify this situation, the draft law proposes to amend Article 9 of the Law "On Civil Status Acts" with a provision allowing individuals with a notarized will to obtain a copy of the death certificate.
