For the first time, the draft law introduces a clear definition of an investment agreement — an official contract between the state and the investor that regulates their rights and obligations. Such agreements serve as the foundation for attracting large projects to the country, with costs exceeding 1 billion soms. The developers emphasize that existing norms are often interpreted differently, leading to delays, disputes, and potential litigation.
The proposed amendments also change the procedure for granting land that is state-owned. Now, the conditions for land transfer will be determined by the Cabinet of Ministers for both citizens of Kyrgyzstan and foreign investors.
The draft law establishes that land plots for the implementation of national projects may be granted for temporary use for a period of up to 50 years.
At the same time, there is a provision for the phased extension of usage rights if the investor fulfills all their obligations.
Particular attention is paid to eliminating legal uncertainty: it clarifies under what circumstances land can be transferred for free, when an auction is required, and how the state can include land plots in the authorized capital of companies with state shares. According to the developers, these changes will help close existing gaps in legislation and reduce administrative barriers.
The explanatory note to the draft law emphasizes that the proposed changes are aimed at protecting the interests of investors, increasing the investment attractiveness of the country, and accelerating the implementation of projects significant for the economy of Kyrgyzstan. The document is available for public discussion, and all interested parties can submit their proposals and comments within the established timeframe.
