
It is proposed to issue licenses to those who have not passed the qualification exam
The Ministry of Justice has initiated a draft law that has been presented to the Jogorku Kenesh. It proposes the introduction of a new term — "localized license," which can be obtained by those who have not successfully passed the qualification exam for obtaining a lawyer's certificate. These lawyers will work in areas where there is a shortage of specialists.
Deputy Minister of Justice Orozbek Sydykov noted that in areas such as Chon-Alai, Nookat, Jumgal, and Ak-Tal, there are no lawyers at all. In the Aravan district, where a significant number of people live, there is only one lawyer functioning. As a result, to provide free legal assistance as stipulated by law, it is necessary to turn to lawyers from neighboring districts, which creates an additional financial burden on the republican budget, as the services of lawyers are paid for by the state.
However, this initiative has faced criticism from Deputy Kubanychbek Samakov. He expressed doubts that the issuance of "localized licenses" would not affect the quality of legal protection for citizens.
“In these areas, qualified prosecutors work, and you want to pit them against lawyers who have not been able to pass qualification tests. Can such a lawyer handle a case on equal terms? Moreover, your initiative resembles a situation where those who have passed the driving test can drive in Bishkek, while those who have not can only drive in the villages,” commented the deputy.
