In Kyrgyzstan, a proposal is made to ban changing gender

On the portal of the Jogorku Kenesh, a public discussion has started regarding a draft law aimed at amending the Family Code, as well as the laws "On Civil Status Acts" and "On the Protection of Citizens' Health." The main goal of this law is to establish the immutability of biological sex in state documents and to limit the possibility of its alteration.

The draft law contains a provision stating that a person's sex is determined solely by biological characteristics established at birth. This record cannot be changed at the request of the citizen, nor on the basis of medical certificates or court decisions, except in cases of correcting errors made by civil registry employees.

The project provides for the introduction of a new article in the Family Code, which defines biological sex as the only category considered when regulating family relationships, entering into marriage, and establishing kinship.

Parents are also obliged to raise their children in accordance with their biological sex.

Amendments to the Law "On Civil Status Acts" will clearly state that the record of sex in the birth certificate is final, and any further alteration of this information will be prohibited. Additionally, a procedure for correcting only technical errors that occurred during the initial registration is provided.

The draft law also introduces significant changes to the Law "On the Protection of Citizens' Health." It includes a ban on medical procedures aimed at changing sex, including surgical interventions and hormone therapy. Exceptions are made only for rare cases concerning the treatment of congenital anomalies of sexual development, confirmed by a medical commission and a court decision.

The authors of the draft law emphasize that it is aimed at protecting traditional family values, preventing legal conflicts, and improving the accounting of personal data.

The explanatory note states that current legislation does not contain clear norms regarding the change of sex, which creates risks for demographic policy, child protection, and the stability of document circulation in the state.

The draft law is available for public discussion on the Jogorku Kenesh website and will be submitted for consideration by parliamentary committees after the discussion concludes.
