The deputy proposes to ban gender change in documents

Deputy of the Jogorku Kenesh Marlen Mamataliev has initiated a draft law that proposes a ban on changing information about gender in official documents. This draft is currently available for public discussion.

As Mamataliev stated, the development of medicine makes gender reassignment procedures more accessible, while legislation in this area is lagging behind changes, creating a legal vacuum. He also noted that issues related to gender identity often contradict traditional spiritual, religious, and moral values of society, making it difficult to find public consensus.

The deputy pointed to the existing legal gap that allows for changes to be made to gender records in civil status acts and passports based on medical documents. In his opinion, such practices lack cultural and historical foundations in Kyrgyz society and may pose risks to demographic policy, public morality, national security, and sustainable development of the country.

Mamataliev also mentioned the emergence of the first appeal to the state institution "Kyzmat," posted on social media, which, in his opinion, underscores the need for legislative regulation of this issue. This is necessary to protect constitutional principles, traditional values, and the institution of the family.

In support of his initiative, the deputy refers to the provisions of the Constitution and the Family Code, where the concepts of man and woman are clearly defined in relation to biological sex at birth. He believes that the possibility of administrative gender change undermines the foundations of family law, creates legal conflicts, and calls into question traditional views on motherhood and fatherhood.

Furthermore, he expresses concerns that the legalization of gender changes in documents could lead to abuses in justice, military obligations, crime fighting, and sports, as well as complicate the work of state registries and accounting systems.

In light of the above, the deputy proposes amendments to the legislation that would explicitly prohibit the correction of records regarding biological sex in civil status acts and other official documents.
