The Ombudsman is to be given control over citizens' rights during a state of emergency

In Kyrgyzstan, a draft constitutional law concerning amendments to the existing Law "On Martial Law" has been submitted for public discussion.

According to the proposal, a new provision will be added to Article 15, which stipulates that the akiykatchi (ombudsman) will exercise parliamentary control over the observance of human rights and freedoms in conditions of martial law.

The justification for the initiative states that the amendments are necessary in accordance with the requirements of Article 109 of the Constitution, which designates the ombudsman as responsible for monitoring citizens' rights.

The current law on martial law defines the duties of state bodies, restrictions on citizens' rights, and measures to ensure security. However, it does not specify which body should monitor the observance of citizens' rights during the period of martial law.

The proposed changes aim to clarify the role of the ombudsman in matters of human rights protection during martial law and ensure the uninterrupted functioning of the akiykatchi institution.

According to the information, the adoption of this law will not require additional budget expenditures and will not lead to negative social, economic, or legal consequences.

The draft law is available for public discussion on the website of the Jogorku Kenesh. The initiator of these amendments is Deputy Baktygul Amanova.
