The plaintiff is Brian King Joseph, a violinist who collaborated with Smith during his concert tour. Joseph accused the actor of harassment and grooming, as well as wrongful termination after he expressed concern about what was happening.
The lawsuit states that Joseph met Smith in December 2024 when he was invited to perform at one of his concerts. Later, Smith offered him to join the tour titled Based on a True Story: 2025 Tour and participate in the recording of a new album. According to the plaintiff, their working relationship turned into Smith showing him increased attention.
Joseph claims that in March 2025, during the tour in Las Vegas, he noticed signs of unlawful entry into his hotel room, which was provided by the tour organizers. Foreign items and a note addressed to him were left in the room. Concerned for his safety, he called hotel security, notified Smith's representatives, and contacted the police.
Days after the incident, the violinist claims he was informed of his termination. According to Smith's representatives, the incident of intrusion was fabricated. The lawsuit also mentions that another violinist was soon hired to replace Joseph, which the plaintiff believes indicates the unjustifiability of the reasons for his dismissal.
Joseph claims he became a victim of retaliation after reporting sexual harassment by Smith.
Smith's attorney, Allen B. Grodsky, stated that Joseph's allegations are false, baseless, and reckless. He noted that their team will use all available legal means to refute these allegations and seek justice.
