Detention of a Nephrologist. Medical Professionals Intend to Appeal to the Constitutional Court

At a press conference regarding the case of the detained nephrologist of the National Center for Maternal and Child Health, Nasira Beishebaeva, Bermet Baryktabasova, the chair of the Independent Medical Union, announced her intention to appeal to the Constitutional Court. She emphasized that the existing regulations deprive doctors of fair protection.

According to Baryktabasova, numerous consultations were held at the NCMCH, where the child's condition was discussed with leading specialists. Doctors faced many factors complicating diagnosis, including several risks of thrombosis and the consequences of a previous COVID-19 infection. "The complexity of the situation is that many previously manageable childhood diseases have become extremely severe," she added.

She also noted that even simple illnesses can lead to serious complications requiring radical solutions, such as amputation. Baryktabasova stressed that society often perceives doctors as guilty if they cannot save a patient, creating a need for a more open dialogue about the complexities of medical practice.

The union leader expressed concern that some individuals are fueling conflicts between society and the medical community. "Conflicts lead to violations of procedural norms. Article 146 of the Criminal Code of the Kyrgyz Republic is not a serious offense, and there is no basis for excessive measures, such as arresting a doctor at the workplace," she noted.

Baryktabasova also pointed out legal conflicts that hinder doctors from defending their rights in court. "We, along with lawyers, have identified shortcomings in the legislation and plan to appeal to the Constitutional Court to ensure the doctor's right to defense and a fair trial," she added. She called for consideration of international standards and statistics indicating the complexity of the diseases doctors face.

"Ignoring expert opinions and the views of professional commissions is a terrible reality," Baryktabasova emphasized.

The union leader also believes it is important for lawyers and the Ministry of Health to analyze the degree of responsibility of medical workers in each specific case. She promised to make efforts to eliminate legal gaps and protect doctors' rights.

It is worth noting that on February 18, a nephrologist, candidate of medical sciences, associate professor Nasira Beishebaeva was detained in Bishkek. According to the Bishkek City Police Department, the detention occurred following a complaint from the mother of a patient who alleged a possible medical error that led to the amputation of her right leg.

A criminal case has been initiated under part 2 of Article 146 "Improper performance of professional duties by a medical or pharmaceutical worker, resulting in serious harm through negligence" of the Criminal Code of the Kyrgyz Republic. The doctor was arrested and placed in a temporary detention facility.

The staff of the NCMCH published a video appeal on social media to the President of Kyrgyzstan, Sadyr Japarov, calling for a fair investigation of the situation. They also requested that the preventive measure for Beishebaeva not be related to arrest.

Health Minister Kanbek Dosmambetov emphasized the importance of an objective and comprehensive examination of the circumstances of the case.

The NCMCH also shared information about how the girl's treatment was conducted prior to the amputation.
