The bill on the reform of homeowners' associations has been submitted for consideration by the Jogorku Kenesh.

The Jogorku Kenesh has received for consideration a draft amendment to the law "On Associations of Owners of Residential and Non-Residential Premises in Apartment Buildings." This initiative aims to improve transparency, legality, and control in the process of creating and functioning of homeowners' associations (TSZh).

One of the main proposals is to change the procedure for forming an initiative group: now only 10% of owners will be required to establish it. Additionally, the group will be responsible for notifying all property owners, as well as for the preliminary appointment of a notary who will certify the authenticity of the signatures of the participants in the founding meeting. This innovation is intended to eliminate cases of forgery and confirm the actual participation of owners.

The draft law also proposes the introduction of a mandatory register of TSZh members, which will contain information about property owners and the dates of their membership. This register will become an important tool for checking the quorum at general meetings, and updated lists of the TSZh will be sent to the registering authority once a year.

Furthermore, it is planned to tighten the rules for decision-making: if the TSZh includes owners of non-residential premises, then the general meeting must be held in person only. The notary will also be required to certify the signatures of all participants at such meetings.

Another important initiative is to extend the term of office for the TSZh board from two to three years, as well as to establish a norm whereby the powers of the board end only after the election of a new composition, which will help avoid management gaps.

The authors of the draft law emphasize that the proposed changes are aimed at combating abuses, protecting the rights of owners, and increasing the efficiency of managing apartment buildings. The document is already available for public discussion.
