Online broadcasts of court hearings have begun in Bishkek

In the Sverdlovsk District Court of Bishkek, an online broadcast of a court session was conducted for the first time, including a case of domestic violence. This became known on March 9 thanks to the press service of the Supreme Court.

Present at the session were the Deputy Head of the Supreme Court's Office Aman Jumaliev and the Deputy Minister of Justice Aibek Aydarov.

The Supreme Court clarified that changes to the Criminal Procedure Code regarding the concepts of "video conferencing" and "online broadcast of court sessions" were made earlier. Now, the right of defendants and other participants in the criminal process to access the minutes of the sessions, including audio and video recordings, as well as the ability to submit comments on them, is legally established.

Moreover, participants in the process can petition for court sessions to be conducted using video communication or for their live broadcast on television, radio, and the internet.

Changes in legislation have allowed the court, at the request of interested parties or on its own initiative, to permit the live broadcast of court sessions on television, radio, and the Internet. This is done to ensure the interests of justice, the transparency of the process, and the safety of all participants.

In particular, paragraph 18 was added to Article 46, granting participants the right to request that court proceedings be conducted with online broadcasting on television, radio, and/or the internet. Additionally, part 3 of Article 280 was supplemented with paragraph 5, which regulates the possibility of broadcasting court sessions through the media or on the internet in an online format.

According to Article 290-1 of the Criminal Procedure Code of the Kyrgyz Republic, the court may, at the request of the participants in the case or on its own initiative, allow the live broadcast of court sessions on television, radio, and/or the internet. The decision to conduct an online broadcast is made by the court, taking into account the interests of justice, the principle of openness, and the safety of the participants in the process.
